Following on from a spate of reports of working holiday makers being exposed to exploitation, the Department of Immigration has teamed up with the Fair Work Ombudsman (‘FWO’) to help employers and employees understand Australian workplace laws. One of the key measures currently being adopted by the Department of Immigration includes helping to spruik the FWO’s new Pay and Conditions Tool (‘the Tool’).
The Tool provides information on pay rates, shift calculations, leave arrangements and notice and redundancy entitlements. This information is primarily delivered through the following easy to use calculators:
- Pay calculator – minimum award pay rates, including penalty rates and allowances
- Leave calculator – annual and sick leave entitlements
- Notice and redundancy calculator – required notice and redundancy entitlements
- Shift calculator – the pay rates of shifts
In addition to the calculators, the Tool includes free and interactive online training modules on relevant topics. This includes training on how to have difficult conversations in the workplace that would cover the situation of an employee who believes they are not receiving minimum pay or entitlements.
The Tool would be a valuable resource for Working Holiday Makers and other visa holders permitted to work in Australia who may not yet be aware of their rights and obligations in the workplace.
